When parties to a marriage have differences and prior to the Divorce, they may wish to live separately and apart from each other, and live their separate lives and not as husband and wife. In such a scenario, both parties may by mutual agreement enter into an agreement, called the Deed of Separation, agreeing and evidencing the fact of living apart from each other.
   
In the Deed of Separation, if the parties desire, they may mutually agree on arrangements or issues relating to custody, care and control of their minor children, maintenance of wife and/or children, and division of matrimonial assets.
   
Once a Separation Deed has been signed by the parties, mutual consent is required to revoke the Deed. Nevertheless, the Court has the right to set aside any of the terms upon application of any party unless the Deed has been sanctioned by the Court.
