Who should I appoint as my
Attorney |
|
|
|
|
|
You can
appoint almost anyone to be
your Attorney. But as you
will be entrusting important
matters to your Attorney, he
/ she should be an adult
person (such as a relative
or a close friend) whom you
can trust. |

How do I obtain a Power of
Attorney |
|
|
|
|
|
You have
to engage a Lawyer (an
Advocate & Solicitor in
Singapore) to prepare the
Power of Attorney using
HDB's prescribed formats.
You should always check and
ensure that all particulars
of the subject HDB flat,
yourself ("the Donor"),
and your Attorney are
correctly and accurately
stated in the PA. |

Types of Standard Formats of
PA prescribed by HDB |
|
|
|
|
|
There are generally 3 standard formats (see items 1 to 3 in the
table below) prescribed by HDB which do not require HDB's prior
approval, and you should inform your Lawyer of the purpose or purposes
for the Power of Attorney.

Your
Power of Attorney must be
signed by you under seal in
the presence of a Lawyer in
Singapore, and thereafter,
your Lawyer will deposit a
copy of your Power of
Attorney at the Registry of
the Supreme Court and the
Court will assign a
Registration Number for your
Power of Attorney. |

Signing Power of Attorney
Overseas |
|
|
|
|
|
If you are signing the Power of Attorney Overseas (outside
Singapore), your Lawyer will send (by courier or airmail) the Power
of Attorney to you so that you can make arrangements to sign it in the presence of a Notary Public or Singapore
Consulate Officer in the country of your stay.

What happen after
registration of PA |
|
|
|
|
|
Once a
copy of your Power of
Attorney is duly deposited
at the Supreme Court, HDB
requires your Lawyer to
furnish a Letter of
Confirmation addressed to
HDB that he or she has used
HDB's prescribed standard
format. |

If I have a Power of
Attorney, is there any
document I still need to
sign personally |
|
|
|
|
|
Notwithstanding the Power of
Attorney, you must
personally sign the
necessary statutory
declaration or other
documents required by HDB relating to the
purchase/resale/sale of the flat.

Do I require a certified
true copy of the Power of
Attorney by the High Court
|
|
|
|
|
|
In October 2002, HDB has revised its requirements of
submission of the original PA or a certified true copy from the High
Court for sale, purchase or subletting of an HDB flat.
The new requirement is to submit to HDB any one of the
following documents:-

the PA by an Advocate and Solicitor together with the computer
printout with the High Court seal where PA has been registered via
the Judiciary's Electronic Filing System (EFS) (together with
2 photocopies of the PA). |
Certified true copy of
the PA by Solicitor will be retained by HDB |
