Signing your Power of Attorney Overseas - Instruction / Important Notes |

If you have applied for our Power of Attorney Online or Offline and wish to sign the Power of Attorney Overseas, you are required to sign the engrossed Power of Attorney in the presence of a Singapore Consulate Officer (usually in the Singapore Embassy, Consulate Office or Trade Office) or a Notary Public (usually a lawyer appointed as a Notary in the country of your stay). |

Full Payment of Charges |

|
After submission, please send us a cheque for our charges issued in our favour (Loh Eben Ong & Partners) to the address below. We require the full payment prior to processing your application or sending the PA to you at the country of your stay. You may also arrange with your relative or representive to make payment in cheque or cash at our office. [Note: For Local Execution, full payment will be made at our office when attending to sign the Power of Attorney] |

Delivery of Engrossed Power of Attorney to Overseas Destination |

|
|
|
Upon your Online or Offline Submission, we will send you the engrossed Power of Attorney in accordance with the Mode of Delivery requested for in your application. |

|
|
| |
Completion of Particulars by Notary Public or Singapore Consulate Officer |
|
| |
|
|
|
Please ensure that the Notary Public or Singapore Consulate Officer (as the case may be) complete all the particulars stated in the Power of Attorney, and sign and affix his/her official seal as shown in our specimen Power of Attorney. Failure to do so may render the Power of Attorney being rejected by the High Court for registration or being queried in respect of the manner or validity of execution. |

Notary Public or Singapore Consulate Officer? |
|
| |
|
|
|
Where available or possible, it is advisable to sign the Power of Attorney in the presence of a Singapore Consulate Officer in the Country of Execution. |
|

|
|
|
For Power of Attorney executed Overseas and witnessed by a Notary Public, the High Court may request for further evidence of due execution by you, and/or verify the validity of the Notary Public’s appointment and/or other particulars. In those scenarios, please note that we will require you to obtain such requirements, and if additional work is required, we may charge additional costs and expense incurred.
You may wish to furnish us copies of the Notary Public’s name card, official receipt for witnessing the Power of Attorney, and/or other evidence of his/her due appointment as a Notary Public. It may be a good practice to attach the Notary Public original Certificate of Attestation (or similar certificate) to the Power of Attorney. |

Prior to your execution of the Power of Attorney, please peruse the said document carefully and ensure that you fully understand the contents and the powers that you are giving to your intended Attorney. If there are errors in any of the particulars in the Power of Attorney, please inform us immediately. |

Proper Execution |

Please be advised that if the Power of Attorney is not properly executed and/or witnessed, the High Court may reject the same for registration. In that event, additional costs and/or expense may be incurred by you for preparation of a fresh set of Power of Attorney and for you to re-sign the same. |

The following specimens Power of Attorney are strictly for reference only. We do not warrant or guarantee that complying fully with the manner of execution as indicated in any of our Specimens will mean that the Power of Attorney will be duly accepted by the High Court for registration. |

Return of Documents |

After execution of the Power of Attorney, please return the same to us together with true copy/copies of your Identity card(s) and/or Passport(s) (if not yet forwarded to us) to the following address:-

Reservation of Rights |

We reserve the right at our sole and absolute discretion not to continue acting for you or require you to re-execute the Power of Attorney (at your costs and expense) or not to register the signed Power of Attorney, if we have doubts as to the due and proper execution of the Power of Attorney. Upon our request for verification documents such as your identification document(s), you shall furnish the same promptly upon request.
If you are not agreeable to this condition, please notify us immediately, and let us have your reasons. |
